Acceptance of Terms
By accessing or using Shelter’s websites, mobile sites, and mobile applications (collectively, the “Online Services”), you agree to these Terms and Conditions (the “Terms”). If you do not agree, do not use the Online Services. We may modify these Terms at any time. Your continued use after posting constitutes acceptance.

Consent to Monitoring and Data Collection
By accessing, browsing, or using the Online Services, you expressly consent to the monitoring, recording, and collection of information about your interactions with this website through cookies, tracking technologies, web analytics tools, and similar technologies as described in our Privacy Policy, which is incorporated herein by reference. These technologies are operated by Shelter and by third-party service providers identified in the Privacy Policy.

Information collected through these technologies may be transmitted to, stored on, and processed by servers operated by third-part service providers for the purposes described in the Privacy Policy, including website analytics, performance optimization, fraud prevention, and improving the services offered through this website.

You acknowledge that your use of this website after receiving notice of these practices constitutes your knowing and voluntary consent to such monitoring, recording, collection, and transmission, including consent as required under all applicable federal and state privacy, wiretapping, eavesdropping, and electronic surveillance laws, including without limitation the California Invasion of Privacy Act (Cal. Penal Code Secs. 630-638.55).

You may manage your preferences regarding non-essential tracking technologies as described in the Privacy Policy. You may also withdraw consent by discontinuing use of this website.

Eligibility
You represent that you are at least 18 years old and will use the Online Services only for lawful, personal, non-commercial purposes.

Ownership; License to Use the Online Services
Shelter Online Services (including content, text, graphics, logos, and software) are protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions and other copyright laws. Subject to these Terms, Shelter grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Online Services for personal, non-commercial use. All materials contained in the Online Services are protected by copyright and are owned or controlled by Shelter or the party credited as the provider of the content. You will abide by any and all additional copyright notices, information, or restrictions contained in any content of the Shelter Online Services. You may download and make copies of any content and other downloadable items displayed on the Shelter Online Services for personal, non-commercial use only, provided that you maintain all copyright and other notices contained in such content. Copying or storing any content for any purpose other than personal, non-commercial use is expressly prohibited without the prior written permission from Shelter or the copyright holder identified in the individual content’s copyright notice.

Changes to the Online Services
Shelter may change, suspend, or discontinue any feature or content at any time, including the availability of any feature, database, or content. Shelter may also impose limits on certain features and services or restrict your access to parts or all of the Online Services without notice or liability.

Prohibited Conduct
You represent, warrant, and covenant not to, and not to enable others to:

  • Violate or infringe any third-party right (including privacy, publicity, copyright, trademark, or patent);
  • Introduce viruses, malware, or harmful code;
  • Make false or misleading statements of fact or origin;
  • Impersonate others or misrepresent your affiliation;
  • Scrape, harvest or use automated means (bots, spiders, crawlers) to access the Online Services except as expressly permitted by Shelter;
  • Reverse engineer, decompile, or attempt to derive source code;
  • Circumvent access controls or rate limits;
  • Conduct security testing without Shelter’s prior written authorization.
  • Upload, post, or transmit to, or distribute, or otherwise publish through the Shelter Online Services any materials which:
    • Restrict or inhibit any other user from using and enjoying the Shelter Online Services;
    • Are unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, offensive, pornographic, profane, sexually explicit, or indecent;
    • Constitute or encourage conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate law;
    • Violate, plagiarize, or infringe the rights of third parties including, without limitation, copyright, trademark, patent, rights of privacy or publicity, or any other proprietary right;
    • Contain a virus or other harmful component;
    • Contain any information, software, or other material of a commercial nature;
    • Contain advertising of any kind; or
    • Constitute or contain false or misleading indications of origin or statements of fact

Your Account (Integrated User Account Terms)
Your Account (My Shelter Account, “MSA”)

  • Eligibility; Account Information. You must be at least 18 and reside in the United States to create an MSA. You agree to provide accurate, current information (including email and mobile number) and to promptly update it. If your contact information is inaccurate or not maintained, you may not receive important notices or security alerts.
  • Credentials, MFA, and Device Security. You are responsible for safeguarding your username, password, one-time codes, security answers, and any other credentials. Where offered, you should enable multi-factor authentication. You are responsible for the security of the devices and networks you use to access your MSA (including operating system and app updates, anti-malware, and avoiding use of shared/public devices). We may require identity verification from time to time.
  • Biometric / Device-Based Sign-In (Optional). If you enable a device’s biometric or device-PIN sign-in (e.g., Face ID, Touch ID, Android biometrics), anyone with enrolled biometrics or device PIN on that device may be able to access your MSA. Manage or disable these features in your device settings. Shelter does not receive or store your biometric templates; your device vendor controls that functionality.
  • Authority to Act on Instructions. Shelter is entitled to act on instructions, approvals, or settings changes that Shelter reasonably believes were authorized by you and that were transmitted through your MSA using your credentials, trusted device, or device-based sign-in. An instruction is deemed received when it is received by Shelter’s systems, not when you submit it from your device. Shelter’s system logs may be used to demonstrate what we received and when.
  • Unauthorized Access; Your Duties. You must (i) keep your credentials confidential, (ii) not share your account or credentials, and (iii) immediately notify Shelter at [CustSvc@ShelterInsurance.com] or [1-800-743-5837] if you suspect that your credentials have been compromised or that unauthorized access to your MSA has occurred or may occur. You agree to cooperate with Shelter’s investigation and to take corrective steps we reasonably request (for example, changing your password, enabling MFA, or reviewing recent activity).
  • Allocation of Risk. Shelter is not liable for losses arising from any unauthorized access to your MSA or personal information except to the extent directly caused by Shelter’s gross negligence or willful misconduct. Nothing in these Terms limits non-waivable rights under applicable law.
  • Third-Party Tools and Aggregators. If you choose to use a password manager, account aggregator, or other third-party tool to access or store your MSA credentials, their terms and privacy policies apply to that tool. Shelter does not control those tools and may restrict automated access to protect security and service integrity.
  • Administrative Communications; Codes and Alerts. By maintaining an MSA, you consent to receive administrative communications (e.g., security alerts, account notices) at the contact details you provide and within the Online Services. Delivery depends on your carrier and device; message and data rates may apply. Delivery of codes/alerts is not guaranteed; you remain responsible for monitoring your account.
  • Paperless & Electronic Delivery. If you opt in to electronic delivery for eligible documents, the separate Electronic Delivery (e-SIGN) section of these Terms applies. You may withdraw consent as described there; withdrawal is prospective only and may affect paperless features or discounts.
  • Security Monitoring; Protective Actions. To protect you and our systems, Shelter may monitor for anomalous activity and may, with or without notice, suspend, throttle, block, or require re-verification of access; reset or require you to reset credentials; or take other protective actions.
  • Account Changes, Availability, and Outages. Features of the MSA may change from time to time. The MSA may occasionally be unavailable due to maintenance, updates, or events beyond Shelter’s control.
  • Closing Your Account. You may close your MSA at any time through Account Settings or by contacting us. Closing your MSA will not affect records we maintain as required by law or your policy documents. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnity, governing law, dispute resolution, and this sentence) will survive any suspension or closure. Closing your MSA does not terminate policies or legal notices delivered under those policies.

Prohibited Uses. You may not impersonate others, misrepresent your affiliation, use another person’s account, share your credentials, or use scraping/automation except as expressly permitted by Shelter.

Information on the Online Services (Non-Substantive)
Content about Shelter’s products/services is for general information only and is not an offer, guarantee, or contract. Insurance coverage is governed solely by the policy issued and the facts of the particular situation. To obtain coverage, you must submit an application; all applications are subject to underwriting approval.

Your Submissions & Feedback
Except for personal information (governed by the Privacy Policy), you grant Shelter a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from suggestions, feedback, and other non-personal submissions, and any other form of communication you provide, without compensation or attribution. You hereby waive all rights to any claim against Shelter for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with such Communications.

Third-Party Links & Services
The Online Services may link to or integrate third-party websites, tools, or content. Shelter does not control or endorse third-party sites/services and is not responsible for their content, policies, or security.

Mobile App Terms (If You Use the App)
You must comply with the app platform’s terms (e.g., Apple App Store, Google Play). The app is licensed, not sold. The platform provider is not responsible for maintenance or legal claims regarding the app, and you acknowledge that Shelter (not the platform) is responsible for addressing any claims relating to the app or your possession/use of it. Apple and Google are third-party beneficiaries of this paragraph to the extent it relates to the app, and may enforce it.

Monitoring & Security
To operate, troubleshoot, and improve the Online Services, we may monitor usage, log interactions, and use analytics and anti-fraud measures. Shelter takes reasonable steps to secure the Online Services but cannot guarantee they are error-free or free from harmful components. Do not submit sensitive information unless specifically requested in a secure channel.

THE ONLINE SERVICES AND ALL MATERIALS MADE AVAILABLE THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, SHELTER AND ITS SUBSIDIARIES AND AFFILIATES MAKE NO RESPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE ONLINE SERVICES, THEIR CONTENT, OR THEIR MATERIALS, INFORMATION AND FUNCTIONS, FOR ANY PRODUCTS OR SERVICES OR HYPERTEXT LINKS TO THIRD PARTIES OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE SHELTER WEB SITE OR ANY LINKED SITE. SHELTER AND ITS SUBSIDIARIES AND AFFILIATES DISCLAIM ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND AVAILABILITY. SHELTER DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SHELTER ONLINE SERVICES OR ANY MATERIALS OR CONTENT CONTAINED THEREIN WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SHELTER ONLINE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SHELTER AND ITS SUBSIDIARIES AND AFFILIATES SHALL NOT BE LIABLE FOR THE USE OF THE SHELTER ONLINE SERVICES, INCLUDING, WITHOUT LIMITATION, THE CONTENT AND ANY ERRORS CONTAINED THEREIN.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHELTER, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUES, DATA, GOODWILL, USE OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE ONLINE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, STATUTORY, OR OTHERWISE) AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL SHELTER’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE ONLINE SERVICES EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations; some limitations may not apply to you, the foregoing limitations shall apply to the maximum extent permitted by applicable law.

Indemnification
You agree to indemnify, defend, and hold harmless Shelter and its affiliates, officers, directors, owners, employees, information providers, affiliates, licensors, licensees, and agents (collectively, the “Indemnified Parties”) from any third-party claims, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of your violation of these Terms or misuse of the Online Services. You shall cooperate as fully as reasonably required in the defense of any claim. Shelter reserves the right to, at its sole discretion and expense, assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In no event, shall you settle any such matter without the written consent of Shelter.

DMCA & Copyright Matters
If you believe content on the Online Services infringes your copyright, please send a notice meeting 17 U.S.C. §512(c)(3) to Shelter’s Copyright Agent:
General Counsel, Shelter Mutual Insurance Company, 1817 W. Broadway, Columbia, MO 65218. Counter-notices must meet 17 U.S.C. §512(g)(3).

Governing Law; Venue
These Terms and all disputes, claims, or controversies arising out of or relating to these Terms, the Online Services, or your use of the Online Services - including but not limited to claims relating to data collection, tracking technologies, cookies, analytics tools, monitoring, recording, privacy, wiretapping, eavesdropping, or electronic surveillance - shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflicts-of-law principles and without regard to where you access the Online Services.

For any claims not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Columbia, Missouri. You waive any objection to the exercise of jurisdiction by such courts, any objection to venue, and any claim that any such proceeding has been brought in an inconvenient forum.

Time to Bring Claims
Any claim or cause of action arising out of or relating to your use of the Online Services must be commenced within one (year) year after the claim or cause of action accrues, regardless of any statute or law to the contrary. Any claim not brought within this period is permanently barred. This limitations period applies to all claims, including but not limited to claims under any privacy, wiretapping, eavesdropping, or electronic surveillance statute or common law theory.

Dispute Resolution
You and Shelter agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Online Services, your use of thereof, or the collection, processing, transmission, storage, or use of any data or information through or in connection with the Online Services (collectively, “Disputes”), including but not limited to claims arising under any federal, state, or local statute, regulation, or common law theory (including without limitation, claims under the California Invasion of Privacy Act, the Federal Wiretap Act ,the California Consumer Privacy Act, or any state wiretapping, eavesdropping, or electronic surveillance law), shall be resolved exclusively through final and binding individual arbitration rather than in court, except that either party may bring qualifying claims in small claims court. The Federal Arbitration Act, 9 U.S.C. Sections 1-16 governs the interpretation and enforcement of this Arbitration Agreement.

Before initiating arbitration, the claimant must send a written notice of dispute (“Notice”) to Shelter at 1817 W. Broadway, Columbia, MO 65218, specifying: (i) the claimant’s name, address, email and telephone number; (ii) a detailed description of the dispute and the specific facts supporting the claim; (iii) the specific relief sought; and (iv) copies of all supporting documents or evidence. Shelter shall have sixty (60) days from receipt of the Notice to investigate and attempt to resolve the dispute informally. No arbitration demand may be filed without compliance with this pre-arbitration process. The statute of limitations and any filing-fee deadlines shall be tolled during the informal resolution period.

Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and, where applicable, its Supplementary Rules for Multiple Case Filings, as in effect at the time the arbitration is initiated. If the AAA is unable or unwilling to administer, the parties agree to use JAMS under its Streamlined Arbitration Rules and, where applicable, its Mass Arbitration Procedures and Guidelines. Arbitration shall be conducted by a single arbitrator.

Unless otherwise agreed, arbitration shall take place in Boone County, Missouri, or at the claimant’s election for claims under $25,000, by telephone or videoconference.

Payment of arbitration fees shall be governed by the applicable AAA or JAMS fee schedule. Shelter shall pay all arbitration administration fees and arbitrator compensation that exceed the amount the claimant would have paid to file a complaint in court.

This Arbitration Agreement shall survive termination of your use of the Online Servies and any amendments to these Terms.  

CLASS ACTION WAIVER
ONLY WITH RESPECT TO THE USE OF ONLINE SERVICES AND THE ACCOMPANYING TERMS FOR YOUR USE, YOU AND SHELTER EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, EXCEPT AS PROVIDED IN THE MASS ARBITRATION PROVISION ABOVE, AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

If this Waiver is found to be unenforceable with respect to a particular claim or request for relief, the parties agree that such claim or request for relief shall proceed in individual arbitration only. If a court determines that the Waiver is unenforceable and that determination is not subject to further appeal, the entirety of the Arbitration Agreement (but not this Waiver) shall be null and void with respect to such claim, and the dispute shall proceed in court subject to the Governing Law and Venue provisions herein.

Miscellaneous
If any provision is held unenforceable, it will be enforced to the maximum extent permissible, and the remainder will remain in effect. The invalid provisions shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ original intent. If modification is not possible, the invalid provision shall be severed and the remaining Terms shall be enforced as written.

These Terms are the entire agreement between you and Shelter regarding the Online Services and supersede prior or contemporaneous communications on this subject. Failure to enforce any provision is not a waiver. Notices by posting within the Online Services are effective upon posting.
